Monthlees Terms of Service

Important Notice: These Terms of Service ("Terms") form a legally binding agreement between you ("you," "your," or "User") and Monthlees and its parent company ("Monthlees," "we," "us," or "our"). By accessing or using the Monthlees website, applications, membership program, APIs, content, and services (collectively, the "Services"), you agree to be bound by these Terms. If you do not agree, do not use the Services.

2. Eligibility; Accounts

You must be at least 18 years old and have the legal capacity to enter into these Terms. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to provide accurate information and keep it current.

3. Membership Program

3.1 Plans, Billing, and Renewal

Membership plans, pricing, benefits, and billing cadence are disclosed at checkout and may change prospectively. Memberships may renew automatically unless canceled before the renewal date. Taxes and shipping may apply.

3.2 Free Trials; Promotions

Trials or promotions may convert to paid plans unless canceled prior to the end of the promotional period. We may modify or terminate promotions at any time, subject to applicable law.

3.3 Cancellation; Refunds

Cancellation and refund policies are described at checkout and/or in the Help Center and are incorporated by reference. Certain purchases may be final sale.

Membership fees are non-refundable unless otherwise expressly stated at checkout or required by applicable law. Canceling a membership stops future renewal charges but does not automatically refund prior membership fees, product orders, shipping charges, or benefits already used.

Monthlees may, in its sole discretion, offer a partial, prorated, store-credit, or goodwill refund in individual cases. Any such exception may be calculated based on the amount actually paid, less any used membership period and less the value of benefits already redeemed, including shipping credits, free shipping, discounts, gifts, credits, or other membership benefits. A discretionary refund in one case does not create a right to a refund in any other case.

4. Orders; Pricing; Availability

We reserve the right to correct errors, cancel orders, limit quantities, or change pricing and availability at any time. Title and risk of loss pass upon delivery to the carrier to the fullest extent permitted by law.

All Content is provided for general informational purposes only and does not constitute medical advice. Products are not intended to diagnose, treat, cure, or prevent any disease.

5.2 Individual Results Vary

Statements about benefits reflect general research and user experiences; individual results vary. Consult a qualified healthcare professional before use, especially if pregnant, nursing, have a medical condition, or take medications.

5.3 Regulatory Status

Products are dietary supplements regulated under applicable law. Statements have not been evaluated by the U.S. Food and Drug Administration or equivalent authorities.

6. User Conduct; Acceptable Use

You agree not to misuse the Services, including by violating laws, infringing rights, attempting to bypass security, scraping without authorization, or interfering with operations. We may suspend or terminate access for violations.

7. Intellectual Property

All Content and Services are owned by Monthlees or its licensors and protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for personal, non-commercial purposes.

8. Third-Party Services and Links

The Services integrate with Third-Party Services. We do not control and are not responsible for Third-Party Services, which are governed by their own terms. Use is at your own risk.

9. Privacy

Our Privacy Policy describes how we collect, use, and share information and is incorporated by reference.

10. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL MONTHLEES OR ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR PARTNERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THE SERVICES OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY.

AGGREGATE CAP: TO THE MAXIMUM EXTENT PERMITTED BY LAW, MONTHLEES’ TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT PAID BY YOU TO MONTHLEES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR (B) $100.

12. Indemnification

You agree to defend, indemnify, and hold harmless Monthlees and its parent company and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including attorneys’ fees) arising from your use of the Services, violation of these Terms, or infringement of any rights of another.

13. Arbitration Agreement; Class Action Waiver

PLEASE READ CAREFULLY. You and Monthlees agree to resolve disputes through binding arbitration on an individual basis, waiving any right to a jury trial or class action, to the fullest extent permitted by law. Arbitration shall be administered by a recognized arbitration provider under its rules. This section survives termination.

14. Governing Law; Venue

These Terms are governed by the laws of Wyoming, without regard to conflict-of-law principles. Where arbitration does not apply, exclusive venue shall be state or federal courts located in Sheridan, WY.

15. Termination

We may suspend or terminate access at any time for any reason. Sections intended to survive termination shall survive.

16. Changes to Terms

We may update these Terms from time to time. Continued use after changes constitutes acceptance.

17. Miscellaneous

Severability, assignment, force majeure, waiver, and entire agreement provisions apply. Headings are for convenience only.
